All patient information is protected, no matter who has the info, or how they acquired it.

So, hypothetically speaking, if I want to call this doctor (not for treatment purposes, just so I can prove a point to a fellow optician), keeping in mind said doctor has no physical access to their former records , and just ask them if they remember seeing this patient and what services this patient was given, is this a HIPAA violation and if so what kind of paperwork do I need on file to do so.

No actually I had someone that was part in a similar act and I want to know if this is a violation for integrity reasons.
It depends on why you are inquiring. If you are inquiring to find out info to treat this patient. i.e. Fill an Rx. Then it would not be in violation of Hipaa. But if you are inquiring just to be nosey, then it would be a violation. Hope that helps
