Up to now, there has been little to report as the College is dragging its feet. The normal process is for both parties to disclose documents to each other and then move to discovery where the lawyers for both sides question the parties involved. The College has been reluctant to give some of the documents but argue that they should go to discovery and then decide what documents are needed.
Hakim's lawyer filed a motion to force the college to turn over documents. Just before it was scheduled to be heard in court in early December, the College caved and gave the documents. But then when one side loses a motion as the College did, they pay costs. The College refused and forced Hakim's lawyer to bring another motion to court asking for costs. The motion was heard on December 10 and the College lost. The College tried to argue that Hakim is delaying by refusing discovery until they get all the documents in disclosure. The judge reprimanded them and told them that is not how it works. First, she said, produce the documents and then go to discovery. She told the College to get together with Hakim's lawyer and move to discovery and ordered the College to pay $6000 in costs to Hakim's lawyer within 30 days.
This is the second time the College lost. Almost 2 years ago, they tried to have the claim tossed out of court but the judge then also did not buy that and told the College to get on with it.
