It's been two weeks since the final appeal has gone through. It's not like the colleges can bust down the door, throw everyone out and board up the places. There's specific legal actions that need to be taken. I don't know what they are, but as the article says, they're trying to figure out what their legal options are. Yes, this has been going on for years, but as Berges kept appealing higher and higher, there wasn't much they could do up till this point.
WRONGO !
(1) They could have kept warning the public . It was their duty to continually warn the public . They failed . They have a full time duty to protect the public , not a part time duty .
(2) They should have charged each and every store and each and every employeee to the full extent of the law. And as new employeees showed up , they should have charged each of them . Or at the very least they should have put a copy of the act in the hands of each employee .
(3) Most leases contain a clause that states that the premises can only be used for legal and lawful purposes. They could have had their lawyers send letters to every landlord. And they still should threaten to sue each landlord.
(4) They should have immediately started the process to change the legislation to give them powers and teeth to deal with this type of thing .
If there is a pot hole in the road that could swallow up your car , does the City have an obligation and duty to warn drivers and barricade it off ? If they only put the barricade up for a day and then take it down and no repairs are done , does that discharge their duty to protect the public ?
Sorry, I don't buy into the theory that there is nothing they could do . If that is the case why does anyone buy a Opticians license every year ?
WE buy it because we believe that it is supposed to be a protected franchise .
They failed , their lawyers failed and they are still failing .
They are "trying to figure out what their legal options are" ??? They should have known those options a long time ago .
Based on the posts in this group it sounds like the location in Thornhill has closed up. At least I think that's what the posts say. Anyone in that area drive past the store?
