Final Settlement Reached in J&J Class-Action Suit

CAMDEN, N.J.--A settlement has been reached ending a five-year-old class-action suit involving Johnson & JohnsonĘs (NYSE: JNJ) Vistakon Acuvue soft contact lenses. The lawsuit, filed in 1996, charged that Vistakon misled consumers by advertising its 1-Day Acuvue lenses for one-day-disposable use, when they were the same lenses as VistakonĘs 14-day Acuvue lenses.

Under terms of the settlement, whose total value was not disclosed, J&J will pay consumers who purchased Acuvue lenses between January 1, 1995, and July 31, 2001, $3 in cash or credit for each box of lenses, plus $1 toward a new eye exam; J&J also agreed to change package labeling and marketing materials.
