The lawyer for the College had filed a motion ages ago to have most of the statement of claim for defamation filed by Jay and Chris tossed out and the case was heard yesterday.

It did not go well for the College

The lawyer tried to argue that an e-mail sent out by the College president in which he said that Jay and Chris had engaged in an angry outburst and had to be removed from the building by security was not defamatory and that the libel claim against the president was not reasnable. The judge interrupted and said "are you kidding me". Later, the College argued that the 1st 30 paragraphs of their claim lacked particularity and the College could not defend itself from vague statements. But, the rest of the claim, the lawyer said, contained far too much detail and was therefore scandalous. The judge said you cannot have it both ways.

In the end, the judge ordered Jay and Chris to remove and amend 8 paragraphs and refile within 7 days but he said that he was satisfied that this is a case of defamation and CIVIL CONSPIRACY by the College to to still the voices of the plaintiffs. He ordered the College to provide a defense within 30 days after receiving the amended claim. And, he told the College to that it is time to get on with the case and to stop wasting time.
