    florida dispensing rules for MD's office

    does anyone here know where I can find info on the rules that regulate an MD regarding dispensing eyewear in florida?
    and how those rules coexist with the board of opticianry laws and rules?

    The board of opticianry has no jurisdiction over MD or OD offices. Employees of such offices are not subject to opticianry laws and rules.

    An individual optician, representing themselves as such, is however subject to board rules, even if working in an MD's or OD's office.

    If the optical affiliated with such a practice is a separate entity, it is subject to opticianry laws and rules.

    thank you for the info

    from your answer I need to know the corporate structure of the dispensary in order to know the answers to all my questions.

    If the dispensary itself is a seperate corporation or entity should it have an optical establishment permit?
    If it is one big practice then a permit is not necessary and they can do what ever they want in regards to dispensing?

    I however will still be required to follow the board rules and laws in order to keep my license in good standing- so where does that leave me in regards to unlicensed activity when I am not around?

    I have a second interview tomorrow- I really need a job but I just don't know how this is going to work.

    Yes it all depends on the status of the business. You are right that if it is a stand alone company, seperate name with its own corporate status, then they are required to have an optical establishment permit with proper license coverage.

    As far as your license when you are not there, you are not responsible for their actions. The holder of the optical est. permit would be the one on the hook. Your time records are what you would use to back yourself up.

    Now back to the real world, I would love to see the Board of Opticianry hash it out with an Ophthalmologist.
    Properly medicated for your protection.

    This question was raised in a CE class I attended earlier this year. The speaker suggested not displaying your license when you are not there. Of course that could potentially lead to problems with your employer.

    OK this topic came up at work today and a very rude co worker basically told me i was stupid. I REALLY want to prove her wrong.

    In Florida, can a doctor on site substitute for a licensed optician if the optician is not there? Over the years I was told the doctor cant unless he owns the dispensary. But the lady I work with insisted that a doctor over rides a license in dispensing, repair, etc.

    If not, can you please direct me to some place I can print or send her to to prove that I am right?

    In Florida, the doctor cannot be employed. he can be a tennant, with a door between his office and the dispensary, or he can be an owner.

    I am almost positive that Florida is a one door state, and cannot be employed by the dispensary. I worked in several and even at Wal Mart, they are an independant D.O. and rent the space. That is one reason Wal Mart has been getting in trouble, they are telling the doctor when he has to work, and arent supposed to.

    If the dispensary is owned by a doctor the OD can be employed.... Take it one step further, Unless the employee/burger flipper of yesterday is an apprentice optician or a licensed optician the board of opticianary has no jurisdiction.

    In essence, you're better off without an education.
